CONDITION AND TERMS OF SALE The purchase on Doctor Shop are conform to D.Lgs n. 185 del 22/05/1999 (italian law), matter of contracts concluded at distance, as concluded outside of commercial places.
1 DEFINITIONS
Related to the general condition of sale on the website www.doctorshop.eu, the following terms have the meaning of:
1.1 "General Condition": are all the condition of sale on the website www.doctorshop.eu, applicable to the relationship between Doctor Shop srl and the customer
1.2 "Doctor Shop Srl" or “Supplier” is the society owner of www.doctorshop.eu, that wants to sell through internet its products to professionals of sanitary and medical sector for their professional activities. The society is based in Milan, Monza street 259
1.3 "Products": are all the products and/or goods and/or services sold by Doctor Shop Srl
1.4 "Customer": is the buyer of products and services, intended as the physical or giuridical person that actually proceed to purchase
1.5 "Site": the set of Web pages viewable on, www.dosctorshop.eu
2 SUBJECT OF THE ON-LINE CONTRACT
As subject of “on-line” shopping is intended the kind of contract made at distance, related to the products and services placed on the site, made between Doctor Shop Srl and the customer organized through its website.
3 FORMALIZATION OF THE CONTRACT
3.1 All the contracts are concluded directly through the access of the customer to the site where, following the instructions, he is supported step by step to the conlusion of the contract for the purchase of the product or the service.
3.2 All the orders transmitted to Doctor Shop have to be fulfilled in all their forms and they have to contain all the necessary elements to find the products or the services ordered, the customer and the place of delivery.
3.3 The order transmitted to Doctor Shop is meant as a contractual proposal made by the customer and shown on line.
3.4 The confirmation of order of Doctor Shop, transmitted to the customer by email at the address he gave, confirms the order’s data and is meant as acceptance of the contractual proposal.
3.5 The contract is conclused, and an obligation for both sides, when the confirmation of order has been sent to the customer.
3.6 Doctor Shop has the possibility under its unquestionable judgement to do not accept incomplete or unfulfilled orders.
4.1 Doctor Shop manage to ship the prodcuts to the customer, selected and ordered with the already expressed methods, through courier.
4.2 The delivery expected time, as conform to the art. 6 del D. Lgs. n.
185/1999 (italian law), are less than 30 working days form the day after the transmition of the order to Doctor Shop.
4.3 The delivery is subject to the payment, by the customer, of the amount with the method choosen between the ones shown by Doctor Shop.
4.4 The fiscal document (invoice) is made by Doctor Shop and based on the details given by the customer during the registration.
5.1 If it is not different expressed, all the prices are VAT included.
5.2 The prices of the single products, shown every time in the website, cancel and replace the previous ones.
5.3 The applied prices are the ones shown on the site at the moment of the order made by the customer.
The products are not supplied for a demo. The customer is resposible for the choice of the products and how they repond to his needs.
If an order exceed the quantity in stock, Doctor Shop accepts only the purchase related to the quantity in stock and will notify to the customer by e-mail when that product will be in stock again or not. Doctor Shop commits itself to respect the time frame given to the customer.
Doctor Shop is not responsible for lack of service due to major force cause of any kind of nature of genre, if was impossible to conlude the shipment in the accorded frame time in the contract. Are major force cause for example, Public Authority’s measures, strikes of Doctor Shop’s or courier’s workers and any other circumstance out of control.
8.1 The customer commits himself, once that the purchasing procedure online is over, to print and store these general condition of sale.
8.2 The information contained in the general condition of sale must be read and accepted by the customer before sending the order, in order to satify the condition of the artt. 3 e 4 del Dlgs. n.185/1999 (italian law). The acceptance is made by clicking on the specific space on the site. If it was not so, the order cannot be concluded.
9.1 The recess right is applicable to the physical person (consumer) that buy for purposes that are not related to their commercial activities. So, are exluded the purchase made by seller, companies or physical person that buy for purposes connected to their professional activities.
9.2 Only the “consumer” has the right of recess within 14 days from the delivery, giving back the product to the seller, who will reimbourse the price paid. When the purchase of a product is related to a gift, the right of recess is legally done giving back both the products.
9.3 To exercise the right of recess the consumer has to get in touch with the Customer Service of Doctor Shop giving the invoice data. In case of partial recess, besides the invoice, the customer must communicate the code/s of the product/s that he want to give back. Within 48 hours from the communication the Consumer must send by registered letter or fax a signed declaration for exercise the right of recess with all the details previously shown to: Doctor Shop Srl, Monza street, 259, 20126 Milan.
9.4 Once received the authorization to give back the goods, within 15 days the consumer must ship with the charge on him the goods. The products must be shipped in perfect condition, unused and with the original packaging. In no case will be accepted shipments to be paid at the delivery.
10 ELECTRONIC PAYMENT
The payments made by credit card or other electronic methods go through a safe connection, directly connected to the bank institution owner or holder of the payment service “on-line” that Doctor Shop uses. Doctor Shop does not store the credit card data and cannot be considered responsible for criminal use of that card.
Doctor Shop can change the norms that discipline these general condition and all the economic condition related to them. The unfavorable changes for the customer will be communicated to him by email at the address that he gave. In this case the customer can, within 15 days from the reception of this communication, recess from the contract. If it was not so, the changes are meant as accepted.
The customer must have devices and progams able to connect to the Internet. If the customer could not view part of all the site no charge or responsibility can be imputed to Doctor Shop.
Doctor Shop can suspend the visibility of the site in all or some of its funcitons related to the needs connected to efficiency or safety of it. In this case Doctor Shop, if is not in urgency, will communicate to the customers in any suitable way as soon as possible.
14 DISPUTES AND APPLICABLE LAW
14.1 Every dispute relative to the application, execution, interpretation and violation of the concluded contract online by the customer and Doctor Shop is subjected by the italian law.
14.2 For what is not disposed, are valid what is written in the online contract concluded by the customer and Doctor Shop.
14.3 It is elected as competent court the Court of Milan.
Conform to artt. 1341 e 1342 c.c. (italian law), the customer declares to have read the general condition shown before in all the points and to accept all of them.
